The use of this site is governed by the TERMS AND CONDITIONS AGREEMENT OF SALE set forth below. Your use of this site or purchase from Blue Seas Tackle Co indicates your acceptance of these terms and conditions.
Blue Seas Tackle Co reserves the right to make changes to this web site and these terms and conditions at any time without any prior notice.
Blue Seas Tackle Co is the service provider; it is also referred to as "Blue Seas Tackle Co", "us" and "we".
Customer is the person or organisation who purchases or seeks services from Blue Seas Tackle Co; it is also referred to as "you".
All orders placed are subject to confirmation and acceptance by Blue Seas Tackle Co.
Blue Seas Tackle Co may vary prices for received orders in the event of price changes. We will advise you if this is the case.
To minimise errors and improve efficiency, orders should be placed using our on-line ordering system whenever possible. Other forms of ordering are accepted only if our on-line ordering system is malfunctioning or you have difficulty using it. Other ordering methods include E-mailing our sales department. For some organisations where a purchase order is necessary, we still encourage the orders to be placed on-line, where purchase order reference details can be entered, and followed by a written summarised purchase order.
Quantity in stock does not take into account the orders already placed, and yet to be processed. It is possible that an order placed earlier will receive the allocation of the item stock shown as in stock at the time of your order. Inventory discrepancy can also affect the accuracy of the stock status displayed on our web site. Gift packs and similar items are subject to colour and model substitutions. This is generally stated within the item listing where relevant.
Any attempt to cancel an order must be made as soon as possible. Cancellations attempted after order despatch will result in the customer having to pay the shipping and handling charges on the package and the cost of shipping the package back.
Cancellations may be communicated by email, clearly stating customer name and relevant details of the order, or from within the customer's account.
For on-line orders, accepted payments include Paypal, selected credit cards (Visa, Mastercard, American Express), Direct Deposit and Bitcoin (contact us for wallet details). We also offer Afterpay where customers can utilise an extended payment schedule.
Alternative means of payment may be offered to wholesale customers. Reference should be made to relevant wholesale terms of trade.
The title of the goods supplied does not pass to the customer from Blue Seas Tackle Co until the full amount is paid.
We do not ship to third party addresses unless that address is known and can be verified by Blue Seas Tackle Co.
Customers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods. Blue Seas Tackle Co will make every effort to deliver on time.
Customers are responsible to have someone at the delivery address to sign for and accept the delivery when shipping services requiring proof of delivery have been nominated by the customer. Cost for re-delivery attempts may be passed to the customers if the delivery address is unattended at the time of delivery.
Blue Seas Tackle Co. accepts no responsibility for orders shipped to incomplete or incorrect addresses. It is the Customers responsibility to provide the correct delivery information prior to shipping of all orders. In the event of a lost shipment, Blue Seas Tackle Co will communicate with the relevant shipping agent on behalf of the Customer, to attempt recovery of the order, but provides no guarantee of success. Orders returned to Blue Seas Tackle Co, by the relevant shipping agent, as undeliverable due to incomplete or incorrect addressing, will be subject to a $15 reshipping fee.
We only accept authorised shipments to -
- In Australia; to BSTC's Sales and Administration Office at 4 Reliance Place, Illawong, NSW, and
- In the US; to BSTC's Logistics Office at 14601 North Bybee Lake Court, Portland, Oregon 97203.
Returns due to Change of Mind
Returns due to change of mind may be accepted within 7 days of you receiving the goods. Returned goods must be returned unopen, in their original condition, and include all the original packaging. Returned goods can be exchanged on their return, or a credit applied to the customer’s account for the original cost of the item, excluding shipping and related costs; no refunds will be given. Shipping and handling costs of the exchange item will be at the Buyers expense.
Returns due to Incorrect Item Received
Buyers may return their goods if they don't match the description provided, within 7 days of the items receipt. Contact us and provide a) a full description of the problem, and b) an image of the item clearly indicating the problem. It may be that we can resolve the problem without a return being required.
If the goods received are not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.
Blue Seas Tackle Co owns the title of any goods shipped with your order that have been despatched in error.
Returns due to Damage in Transit
On receipt of a package from us you should inspect the package closely before opening it. If damage to the packaging is apparent you should refuse delivery and have the package returned to us by the responsible carrier. On return from the carrier, we will reship the goods to you, at no cost to you.
If that is not possible, any damaged items received must be reported to Blue Seas Tackle Co within 24 hours of you receiving the delivery. You must provide clear images of the item and damage, and a detailed account of what has occurred, as fault may lie with the relevant delivery agent.
Packages that, in our exclusive opinion, appear to have been opened prior to return will be deemed to have been interfered with, any claim fraudulent, and no returns will be recognized.
If the Goods are to be returned we will issue a Returns Advice. Please attach details of the Returns Advice, a copy of the original invoice or the original invoice number when you do so. Goods returned without the Advice will not be accepted.
The Customer is responsible for all costs involved in sending any goods back to Blue Seas Tackle Co. Blue Seas Tackle Co is not responsible for any parcel missing in transit on its return back to Blue Seas Tackle Co. Where applicable, refunds of shipping costs for returned goods will be limited to the shipping method specified within the Returns Advice.
On receipt, we will endeavour to process your return within 7 days of receipt of the goods.
All goods sold by Blue Seas Tackle Co come with a warranty to be free from any defects or faults. For faulty products, we offer a 30 DAY* REPLACEMENT WARRANTY, from the date you receive your product. (*Some products may have longer Warranty periods.) We do not offer a satisfaction guarantee on any of our products. This Warranty only covers the item(s) sold by Blue Seas Tackle Co and is not transferable.
Goods under warranty cover will be replaced, repaired, or refunded as a store credit as appropriate, and at the sole discretion of Blue Seas Tackle Co. No cash refunds will be provided under any circumstances.
All warrantees are voided if returned product is found in any way to be mishandled, installed incorrectly, modified, tampered, abused, or physically damaged.
If the returned goods are determined by Blue Seas Tackle Co to not be faulty, then all returning shipping fees will be at the customers cost. We will seek the permission from the customer to charge this cost to the customer's credit card where possible. Failing this, the goods will be sent back by Australia Post COD freight collected. Blue Seas Tackle Co also reserves the right to charge the labour cost for examining these goods where no fault was found.
Australian Consumer Law
At all times, the laws applicable under Australian Consumer Law apply. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice.
